A Composix Kugel mesh class action lawsuit has been filed in Rhode Island and individual hernia patch lawsuits have been filed by patients throughout the United States injured by defective Kugel patches. Reported problems with the defective hernia repair recoil rings breaking increased leading to a recall in 2005. According to a March 2007 article in the New York Times, Davol knew of problems with the Kugel mesh patch years before the 2005 recall.
In early 2006, the FDA inspected the Kugel hernia patch manufacturer Davol’s headquarters. Inspectors found “discrepancies” and “inconsistencies” in how Davol tracked complaints. The FDA issued a warning letter to the manufacturer citing serious problems such as the lack of procedures to handle everything from complaint investigation to the determination of actual recall actions.
The majority of cases that people typically refer to as a “Kugel Mesh class action lawsuit” are being handled through what is called multidistrict litigation or “MDL”. Lawsuits involving hundreds or thousands of individuals are often referred to as class actions, however they are typically in the form of multidistrict litigation.
The majority of hernia patch lawsuits have been consolidated in Rhode Island where Davol is headquartered. Cases are still pursued individually. This means that individuals affected by the defective hernia mesh patch recall maintain control over their case. Multidistrict litigation typically only involves discovery matters and cases are returned to the original court in which they were filed after the completion of the discovery stage of the Kugel mesh litigation.
